This kit may help you if:
- you are going to be assessed for a non-economic
loss (NEL) and want to understand how the process works
- you have a NEL assessment or award and
want to object to it
- you have a NEL award and want to apply
for an increase
About This Kit:
This kit is divided into two parts. The first
part entitled, The NEL Process, will lead you step-by-step
through the Workplace
Safety and Insurance Board (WSIB) procedures for deciding
the amount of your award. It will also identify some of the areas
where you might need help. The second part entitled NEL Problems
explains how to get through some of the rough spots in the process.
This kit explains the law in general terms.
It is not intended to give legal advice. You will find the actual
law in the Workplace
Safety and Insurance Act, 1997, (WSIA) the
regulations and WSIB policies. Decisions of the Workplace
Safety and Insurance Appeals Tribunal (WSIAT) interpret
the law, but are not binding. If you need more help, contact a
qualified representative.
This kit does not deal with the process involved
